With the approval of the supplementary provisions of Legislative Decree no. 112/2017 on the Social Enterprise, which took place on 17/07/2018, corrective measures were introduced in tax and financial matters.
The non-taxability of sums directly reinvested in activities of general interest or destined to reserve for possible losses and of those destined for the payment of contributions for carrying out the inspection activity has been envisaged, excluding the concessions for all profits and operating surpluses otherwise employed. At the same time, tax relief is established for any distribution of profits to shareholders, even if this occurs against a free capital increase within the limits of ISTAT variations.
As regards the regulation of the capital investments of Social Enterprises, the regulation relating to these has been aligned with that envisaged for innovative start-ups (art. 25, Legislative Decree no. 179/2012) already approved by the European Commission. This will make it possible to reward savers who choose to invest in solidarity bonds and social lending by financing social enterprises.
