Although not yet published in G.U., the Minister of Labour has signed the decree approving the Guidelines adopted pursuant to article 7 of the Code of the Third Sector.

The Guidelines are addressed to all third sector entities, regardless of their legal form, size, mission, activity and classification as commercial or non-commercial ETS and are aimed at directing the activity of fundraising in line with the principles of truth, transparency and fairness expressly recalled by Article 7 of the Code, in which for the first time the civil recognition of the fundraising activity has found space. In them, the theme of fundraising is treated in a substantial way, while in terms of taxation "the competent Financial Administration will intervene with specific documents of practice, circulars or documents of address".

They are configured as a "open" document, able to develop the ideas for reflection that may emerge from the collection and development of good practices by public and private stakeholders involved and are aimed at directing the activity of fundraising consistent with the principles of truth, transparency and correctness, expressly recalled by article 7 of the Code and deepened, in fact, by the ministerial measure that defines them "cardinal principles aimed at protecting donors, recipients of donations and the ETS itself".

Very strong is also the reference to compliance with the Privacy Law: the reference is to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, whose core principle is so-called accountability.

Finally, the guidelines offer a general framework, expressly defined as "non-exhaustive or binding", on the different techniques through which to proceed with fundraising. It is essentially an update of the good practices identified by the former Third Sector Agency in the guidelines published in 2011 with reference to:
