Reaffirming the principles set out in the recent ruling of the Plenary Meeting n. 6 of 20 February 2020, the sentence of the third section of the Council of State published on 10 December last, reaffirmed:
the non-necessity, for the purposes of challenging the administrative act, of an extraordinary legitimacy conferred by the legislator;
the topicality of the double-track assessment criterion, according to which collective bodies and above all associations, where they meet certain requirements to be ascertained on a case-by-case basis (actual representativeness, statutory purpose, stability and non-occasional nature and, in certain circumstances, also connection with the territory), are entitled to appeal;
the existence of both a legislative and living law path characterized by the progressive increase in the protection and juridical protection of widespread substantial interests, i.e. shared and non-exclusive because they exceed the sphere of individuals, recognizing their importance through an exponential body that if assumes statutory and not occasional representation.
