The TAR of Campania, with a sentence published on 9 January last, after an in-depth and valuable excursus of the relationship between the Third Sector Code and the Procurement Code, reached the conclusion that the coordinated reading of the articles 56 and 57 of the TU 117/2017 allows the administration to entrust the service of transporting the sick, and in particular those in an emergency (118), to voluntary associations, without application of the TU 50/2016, due to the choice of the Legislator to "favor" for the social management of these emergency public services. However, the aforementioned provisions do not prescribe an obligation of "enhanced motivation" on the part of the administration if the assignment of the service is arranged through a public tender.
