Yesterday, 10 September 2018, the last corrective decree on the reform of the Third Sector, approved by the Council of Ministers on 2 August, was published in the Official Gazette.

The deadline for the statutory adjustments of OdV, Aps and Onlus necessary for alignment with the Reform was therefore definitively extended to 3 August 2019; the necessary changes must in any case be approved with the majorities and in the manner required for the ordinary meeting.

In an attempt to better coordinate the civil and tax regulations on accounting matters, new reformulations of articles were also approved. 13 and 87 of the Code.

The provision according to which the cash report must be produced within four months of the end of the financial year no longer applies; on the other hand, this can only be drawn up by non-profit organizations that have a limit of proceeds of 220 thousand euros. It is also envisaged that the instrumental and secondary nature of any "other activities" than those of general interest carried out by the ETS must be documented in a mission report, in a note placed at the bottom of the cash flow statement and/or in the notes to the financial statements .

With the corrective, the exemption from registration tax was also reintroduced for the deeds of incorporation and for those connected to the performance of voluntary activities organized by the OdV.

Further exemptions are provided for private individuals who will carry out acts free of charge by setting up or making donations in favor of trusts or special funds according to the provisions of the law on Dopo di Noi (Legislative Decree No. 112/2017).
