The Council of State reiterates the prevalence of special discipline in the field of social cooperatives on Decree No. 112/2017: "the only really descriptive discipline of the activities exercisable by the social cooperatives remains the fundamental one of which to law n. 381/1991since the regulations referred to in dd.lgs. n. 112 and 117 of 2017, rather than interfering on it, are limited to regulate the macro categories (in which are also included social cooperatives) relating respectively to social enterprises and third sector entities, defining the relative assumptions".
