The Constitutional Court examined article 55 of the Third Sector Code, basing the full legitimacy of the provisions of the law on the Constitution and also on the European regulatory framework. “With this sentence, the Constitutional Court finally agrees with the arguments supported by the Forum, namely that through the tools of co-programming and co-planning, a collaborative practice is defined between public institutions and third sector entities, in recognition of a common purpose to the pursuit of the general interest of the community and in full implementation of the constitutional principle of subsidiarity. The Court not only dismantles the line supported, in some cases, by the administrative justice but, through a careful examination of all the legislation concerning the Third sector and the previous sentences of the Supreme Court itself, definitively consolidates its constitutional value. This is a very important turning point”.
